Welcome to Marine Learning Systems (“MLS”). We are committed to protecting the personal information collected, used and disclosed during the delivery of our services and the use of our websites and products (together our “Services”).

MLS is a Canadian company subject to British Columbia’s Personal Information Protection Act (“PIPA”), which sets out rules for how private bodies collect, use and disclose personal information. We also comply with applicable privacy and data protection legislation in other locations where we operate.

If you do not want MLS to use or disclose your personal information in the ways identified in this Privacy Notice, you should not use our Services.

“Personal information” means any information about an identifiable individual or information that can be used to identify an individual. Examples include name, email address, IP address, residential address and telephone number. The definition also covers more sensitive information like gender, age, health status, family information, and ID numbers.


How Marine Learning Systems uses personal information

MLS will only collect, use or disclose personal information that is necessary to fulfill the purpose of collection. MLS uses personal information to:

  • Deliver our Services.
  • Respond to requests for information, including sales and demos.
  • Contact individuals for the purpose of providing the Services and providing notifications relating to the Services.
  • Provide support.
  • Bill, process and/or collect payment.
  • Monitor website visits and usage to improve design and conduct trending analyses.
  • Comply with laws, regulations, court orders, subpoenas, or other legal process or investigation.
  • Protect ourselves and other individuals from harm.

MLS may require access to personal information to assist with technical support issues. Most technical support issues can be resolved without MLS viewing personal information.
MLS creates anonymous data from personal information to perform statistical analyses and generate additional data. This data cannot identify you, and it is not used to monitor or track you.


Consent

As a Canadian company, MLS takes a consent based approach to processing personal information. Where consent is required to deliver our Services, we will obtain it from individuals at the point of collection. We rely on our customers to obtain consent or have another legal basis for processing the personal information they provide in order to engage our Services.


Disclosure

MLS will not sell, rent, trade or otherwise disclose personal information to third parties for any purpose other than those specified at the time of collection, unless we obtain consent to do so.

The third-party service providers we use to deliver the Services do not have the right to use the personal information we disclose to them beyond what is necessary to provide the tasks and services on our behalf.


Retention of personal information

MLS retains personal information only as long as necessary to fulfill the identified purpose or as permitted or required by law, which may extend beyond the termination of our Services.

We also retain certain information as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data. All retained personal information will remain subject to the terms of this Privacy Notice.

When we have no ongoing legal or legitimate business need to retain personal information, we will delete it, anonymize it, or securely store it until deletion is possible.


Location of Services

MLS hosts the Services in Canada, the United States, and other international locations.

You understand that your personal information may not be protected under the same legislation as in Canada and may be subject to access by law enforcement in a jurisdiction other than Canada. For more information please contact our Privacy Officer.


Individual access and accuracy

Individuals have the right to access the Personal Information that MLS holds about them in order to verify their personal information.

You may request access to the personal information we hold about you to update it, make corrections to it, or delete it at any time, subject to limited exceptions. In some circumstances, we may not be able to comply with requests. If so, we will provide reasons for not complying.


Third party websites

It’s important to guard your privacy when you are online. If our Services contain links to other websites, this Privacy Notice does not govern those websites. Whether we have posted those links, or other organizations or individuals have, you should read those other websites’ privacy notices and make an informed decision about whether you want to use those websites or services.


Data subjects in the European Union and United Kingdom

MLS delivers Services to and acts on behalf of our customers, some of which are data controllers in the EU and UK. Individuals located in the EU and UK have certain rights under European law (including under the General Data Protection Regulation) with respect to personal information, including the right to request access to, obtain, correct, amend, or limit the use of personal information. Data subjects must contact the data controller for more information or to exercise their rights related to their personal information.

Safeguards

MLS uses administrative, technical and physical safeguards to protect personal information in compliance with legal requirements and aligned with industry best practice.

We review and update our security policies and controls as technology changes to ensure ongoing security of personal information. We have implemented procedures designed to limit the access to personal information to only staff who need it to perform their duties and to carry out the stated purposes. We use contracts to ensure that third parties acting on our behalf also maintain reasonable and appropriate safeguards. However, no internet or email transmission is ever fully secure or error free, and no security system is impenetrable. We cannot fully guarantee the confidentiality of any information that you share while using the Services.


Cookies and other tracking technologies

MLS collects information from website visitors automatically. This includes the URL of the site you came from, your browser, your Internet Protocol (IP) address, date/time of access, data transferred, pages visited, amount of time on the websites, transactions conducted, and other “clickstream” data. This information is used to assist us in our marketing efforts, help diagnose technical problems, and to improve our websites.

MLS uses functional cookies on our website to deliver the desired functionality and user experience and analytics cookies to collect and analyze aggregate visitor behaviour. Cookies help us better understand how our websites are used and to improve them, as well as provide visitors the benefit of not having to re-enter the same information over and over again. You can disable cookies and still obtain access to most of our websites.

Information about website visitors may be collated and analyzed by third party services like Google Analytics, however we respect Do Not Track requests and website visitors can opt out of cookies and the use of analytics services.


Employment Information

MLS collects personal information related to employment applications and personal information required to manage employment relationships. Please contact our Privacy Officer for more information about the management of applicant and employee personal information.


Changes to this Privacy Notice

MLS will post any changes to this Privacy Notice and will provide a more prominent notice for significant changes (including email notification for certain changes). We’ll also keep prior versions of this Privacy Notice in an archive for review.
